The Fusion legend is automatically re-ordering the categories after right clicking to expand all and collapse all map layers

The Fusion legend is automatically re-ordering the categories after right clicking to expand and collapse all the map layers. The categories should not re-order themselves as this is quite confusing to users especially if there are a lot of map layers. I am using internet explorer 7
