Query WMS does not work if no layers are selected as "info_default"

If all layers of all WMS have "info_default" UNCHECKED, you will receive an alert informing there are now layers to select (this is correct). Go to the TreeGDE and select a layer to query, and the alert is still present. It seems that adding another queryable layer will sometimes make both layers queryable. Once the layer is queryable, unchecking the query box in TreeGDE does not turn it off.
