Wrong order for XML tags within <GDAL_WMS>

Description
According to documentation (http://www.gdal.org/frmt_wms.html), <Layers> tag should be after <Transparent> tag. However this does not work and GDAL is unable to open the dataset.
If i move up the tag <Layers> and put it after <ServerURL> then it works
So either the documentation or code is incorrect.

sorry mistake on my side
