Even with the fix in #1391, we are encountering this issue with IE7 depending on how fast various scripts load with Fusion (which uses Jx/MooTools which defines a $ function).  We are proposing to move the definition of $() out of Util.js into it's own file so that it can be excluded from the build process where that makes sense.
