You're right. Can you please file a ticket about this?

BTW I had noticed the issue for WMS 1.0.0 already: SERVICE
 does not exist at all in that revision so we cannot require it
 for 1.0.0 at all.

OOpps... closing as duplicate. I had forgotten about this ticket and created a new ticket (#2737) this morning.

The issue is now fixed in trunk and in the 5.2.x branch. See ticket #2737 for the resolution details.
