MapServer dies when spatial Index is out of date (has less entries than shapefile)

Dear MapServer-Devs,

while working with MS 4.10.3 I encountered a problem while accessing a shapefile which has a .qix-indexfile, which was out-of-date. The index had less entries than the shapefile so MS (php4/MapScript and shp2img) died with * glibc detected * malloc(): memory corruption: or * glibc detected * double free or corruption (!prev):
